2.1. PA provides a combination of legal and non-legal business services. Legal services are exclusively provided by qualified lawyers registered with the Ordem dos Advogados.

2.2. Our consulting services include business strategy, investment advisory, and technology consulting. These services do not constitute legal advice and are not subject to lawyer-client privilege.

2.3. PA reserves the right to refuse services that would violate professional ethics or regulatory obligations.

3. USER ELIGIBILITY & CLIENT RESPONSIBILITIES

3.1. By using PA’s services, you affirm that you are legally capable of entering into agreements and providing accurate, truthful information.

3.2. Clients understand that legal advice is specific to individual cases and should not be construed as general guidance applicable to all situations.

3.3. Clients must disclose any potential conflicts of interest that may affect service provision.

4. CONFIDENTIALITY & PROFESSIONAL ETHICS

4.1. PA adheres to strict confidentiality obligations under Portuguese and EU laws, including legal professional privilege where applicable.

4.2. All professionals associated with PA are bound by ethical codes and internal confidentiality policies to protect client information.

4.3. Any breach of confidentiality by PA professionals will be subject to disciplinary action and may be reported to regulatory authorities.

4.4. Clients acknowledge that confidentiality applies only to information disclosed within the formal legal mandate and is subject to legal limitations.

5. CONFLICTS OF INTEREST

5.1. PA is committed to avoiding conflicts of interest in providing its services.

5.2. If a conflict of interest arises, PA will disclose it and, if necessary, decline or withdraw from representation in legal matters.

5.3. Clients must also disclose any conflicts of interest that may affect service provision.

6. LIABILITY & DISCLAIMERS

6.1. PA provides its services on a best-effort basis and makes no guarantees regarding financial or strategic outcomes from business consulting.

6.2. Legal services are provided in accordance with Portuguese and EU law, but PA is not responsible for misinterpretations or legal developments after advice is given.

6.3. PA is not liable for third-party reliance on general website content or materials provided outside a formal engagement.

6.4. The engagement of legal services is formalized through an Engagement Letter, Service Agreement, or other written communication, including email, specifying the scope, terms, and responsibilities of the engagement.

7. PAYMENT, FEES & CANCELLATIONS

7.1. Fees for services will be agreed upon before engagement and are subject to Portuguese taxation and invoicing regulations.

7.2. Cancellation policies for services will be determined on a case-by-case basis. Refunds are not guaranteed unless legally required.

7.3. Any overdue payments may be subject to penalties and collection measures under Portuguese law.

7.4. PA does not accept conditional or contingency fees for legal services, as per Portuguese law.

8. DATA PROTECTION & GDPR COMPLIANCE

8.1. PA complies with the General Data Protection Regulation (GDPR) regarding client data collection, storage, and processing.

8.2. Clients have the right to access, modify, or request deletion of their personal data; personal data may be retained for the period necessary to comply with professional obligations and statutory requirements.

8.3. PA will not share client data with third parties without explicit consent, except when required by law.

9. INTELLECTUAL PROPERTY

9.1. All content on the PA website, including legal templates, consulting strategies, and proprietary documents, remains the intellectual property of PA unless explicitly transferred.

9.2. Clients are not permitted to reproduce, distribute, or commercially exploit PA materials without prior written consent.

10. GOVERNING LAW & JURISDICTION

10.1. These Terms and Conditions are governed by Portuguese law.

10.2. Any disputes arising from these Terms shall be resolved exclusively by the courts of Sintra, unless an alternative dispute resolution method is mutually agreed upon.

10.3. Clients may also resort to alternative dispute resolution (ADR) mechanisms or submit complaints to the Portuguese Bar Association (Ordem dos Advogados) where applicable.

11. COMPLAINTS & DISPUTE RESOLUTION

11.1. Clients may submit complaints regarding legal services to the Ordem dos Advogados, in accordance with the professional regulations.

11.2. For non-legal services, clients may contact PA directly via the contacts below. Where applicable, PA will inform clients of access to ADR platforms such as Centro de Arbitragem de Conflitos de Consumo.

12. CHANGES TO TERMS & CONTACT INFORMATION

12.1. PA reserves the right to modify these Terms at any time. Changes will be posted on our website and take effect upon publication.
